and whereas, the Licensee contacted the Licensor and requested
to allow him to use and occupy his flat with Hall, Dining, two bathrooms,
3 B/R, one kitchen, admeasuring about 1250 sq.ft. in a building constructed on Plot No. _ , out of S. No._____in _________________, on leave and licence basis for a period of eleven months.

and whereas, the Licensor agreed to allow the Licensee to use and occupy said premises on first floor, hereinafter referred to as “Licensed Premises” on terms and conditions, which are mentioned herein below.

Now this agreement witnessth and it is hereby agreed to by and between the parties as follows :

  1. The Licensor has permitted to the Licensee to use and occupy his Licensed Premises admeasuring 1250 sq.ft. for temporary period of 11 (Eleven) months only commencing from 01.09.2005 on leave and license basis.
  1. The Licensee shall pay to the Licensor a monthly compensation of Rs.11,000/- (Rs. Eleven Thousand Only) on or before 6th day of every month according to the English Calendar towards the compensation for the permissive user of the licensed premises. The failure of the Licensee to pay the monthly compensation or two consecutive months shall amount to the breach of Agreement. 
  2. The Licensee has in addition issued D.D. No. ___________ dated _____________ in favour of the Licensor drawn on ____________________________ Bank of Rs.90,000/- (Rs. Ninety Thousand Only) as a security deposit towards the performance of this agreement, which shall be refundable on termination of this agreement without any interest. 
  3. It is further agreed between the parties that the Licensor shall return the said security deposit without interest, but subject to any deductions that may be made therefrom for any amount that may be due by the Licensee to the Licensor.  The Licensor hereby acknowledges the receipt of the said D.D. No. ___________ towards security deposit.
  1. The Licensee shall pay for the M.S.E.B. monthly charges through the Licensor. The Municipal taxes in respect of the licensed premises shall be paid by the Licensor.  Maintenance charges of Madhav Memory Apartment  shall be paid by Licensor.
  1. It is hereby specifically agreed that the period of license shall be 11 months only commencing from ____________ and after the expiry of the said period of the license, the Licensee shall vacate the said premises without causing any damage to the licensed premises and in good condition.
  1. The Licensee shall use the said premises for his residential purpose only.
  1. The Licensee shall not cause any damage, alteration or addition of nay nature in the licensed premises during use and occupation of the licensed premises.
  1. It is specifically agreed that the Licensee shall not have any sort of interest in the license premises and shall not claim tenancy or any other right, title or interest of whatsoever nature in the licensed premises. The Licensee is only allowed to use the licensed premises as a permissible user and as a Licensee for residential purpose limited to eleven months only. It is further agreed that the Licensee shall not grant sub-license to any other person and shall not keep any other person in place or instead of him.
  1. The Licensee shall not cause any nuisance or annoyance to the people in a neighbourhood or store any hazardous goods on the premises.
  2. The Licensor shall have duplicate key of the license premises.
  1. The Licensor shall have a right to inspect the license premises on any day during day time and the Licensee shall have no right to obstruct the Licensor or any of their authorised persons from taking inspection of the said premises.
  1. The Licensee shall not assign, handover or otherwise allow any other person to use and occupy the said premises or any part thereof at any time during the continuance of the license.
  1. It is distinctly agreed by the Licensor and the Licensee that the Licensor has merely allowed the license to occupy and make use of the licensed premises on a pure Leave and License. Nothing contained in this agreement construes as creating a relationship of Landlord and Tenant between the Licensor and Licensee.
  2. On the expiry of the agreement, the Licensee shall handover vacant and peaceful occupation to the Licensor without any objection whatsoever. After the expiry of the eleven months period, Licensee shall have the option of request for renewal of the Leave and License agreement, which the Licensor may reject or accept on new terms and conditions entirely at his discretion.
  1. The Licensee shall not commit any default in the payment of the monthly compensation to the Licensor and default in payment of the license fee or compensation for a period of two consecutive months shall amount to termination of his agreement. The Licensee shall pay the above said monthly compensation to the Licensor on or before every sixth day of the month.
  1. The Licensee shall take permission in writing of the Licensor before making any furniture to be affixed in the licensed premises or the Licensee shall not remove or take away the furniture made of permanent nature.
  1. The Licensee shall be bound to observe and follow all the rules, regulations, bye–laws made by the condominium of Madhav Memory Apartment.
  2. If the Licensee commits a breach of any term of this agreement than not withstanding anything herein contained the Licensor shall be entitled to terminate this agreement by fifteen days prior notice to the Licensee.
  1. The Licensee shall bear and pay all the necessary stamp duty and registration charges of this agreement. The Licensee shall lodge this agreement for registration with information to the Licensor.

WHAT CONSTITUTES A BASIC RENTAL AGREEMENT WHILE EXECUTING FLAT RENTAL AGREEMENT?

The license period could vary from 1 month to 60 months. Rent agreement could be made for the period upto 60 months i.e 5 years. Similarly, we can also make 5 year commercial lease agreement but to avoid additional stamp duty upto 5 years we can go for a commercial property rental agreement. However long term rental agreement are recommended for stable nosiness like hospital, clinic, medical shops etc. For warehouse lease agreement is better option. For restaurant lease agreement is better option.

There is no concept of renewal in the registered rent agreement because each agreement gives the power to use the licensed premises for particular time only and after the said period expired you have to execute another agreement. However, you can put the renewal clause for your own record to avoid misunderstanding in future.

Furniture and Appliances: The said premises is having the Furniture and Appliances mentioned in the Schedule II. The licensee shall maintain the said Furniture and Appliances in the said premises in its existing condition and damage, if any, caused to the said Furniture and Appliances, the same shall be repaired by the Licensee/s at its own cost subject to normal wear and tear.

Purpose of Tenancy: residential purpose or commercial (Its is very important to mention if you given the premises on residential basis and mentioned as non-residential it could be offence under local laws for giving residential premises for commercial purpose.

Use: That the Licensed premises shall only be used by the Licensee for ________________purpose. The Licensee shall maintain the said premises in its existing condition and damage, if any, caused to the said premises, the same shall be repaired by the Licensee at its own cost subject to normal wear and tear. The Licensee shall not do anything in the said premises which is or is likely to cause a nuisance to the other occupants of the said building or to the prejudice in any manner to the rights of Licensor in respect of said premises or shall not do any unlawful activities prohibited By State or Central Government.

  • Rent & Deposit: The rental amount and its breakup

Rent amount monthly to be paid and specify the date on which it should be compulsorily paid. The due date for paying the rental amount must be mentioned. Example: ‘The rent shall be paid by the 5th day of each calendar month.’

  • if the rent may be increased or not, how much (percentage) and after that calculated amount.

You need to mention who will pay Maintenance bill, to be paid to any committee, society etc, Charges of water supply, electricity and will it be additional or inclusive of rent amount.

 

  • Maintenance Charges:

That the all outgoings including all rates, taxes, levies, assessment, maintenance charges, non occupancy charges, etc. in respect of the said premises shall be paid by the Licensor.

 That the Licensee/s herein shall bear and pay all the maintenance charges in respect of the said Licensed Premises, and other outgoings including all rates, taxes, levies, assessment, non occupancy charges, etc. in respect of the said premises shall be paid by the Licensor/s

  • Electricity Charges:

The licensee herein shall pay the electricity bills directly for energy consumed on the licensed premises and should submit original receipts to licensor indicating that the electricity bills are paid.

The agreement may specify the mode of payment. Example: ‘The rent shall be transferred to the Account of the Landlord, details of which are provided below……..’

  • Payment of Deposit:

  • Alteration: It should be mentioned in the agreement if any alterations can be made to licensed premises by the Licensee/tenant, whether permanent and temporary.

 That the Licensee shall not make or permit to do any alteration or addition to the construction or arrangements (internal or external) to the Licensed premises without previous consent in writing from the Licensor.

  • No tenancy and sublet clause-

It is very important clause of the Licensor who is the owner of the premises and tenant shall not create tenancy rights/ tenancy contracts on this limited period license and claim benefits under Bombay Rent control Act and also shall not give the licensed premises to any other person by subletting it.

  • No Tenancy:

That the Licensee shall not claim any tenancy right and shall not have any right to transfer, assign, and sublet or grant any license or sub-license in respect of the Licensed Premises or any part thereof and also shall not mortgage or raise any loan against the said premises.

  • Notice :

Notice period information should be mentioned in the agreement which may be given to the other party for terminating the rental agreement before the expiry of the same. Sometimes it could be 1 or 3 months notice period from either side.

  • Cancellation:

That, if the Licensee commits default in regular and punctual payments of monthly compensation as hereinbefore mentioned or commit/s breach of any of the terms, covenants, and conditions of this agreement or if any legislation prohibiting the Leave and License is imposed, the Licensor shall be entitled to revoke and/or cancel the License hereby granted, by giving notice in writing of one month and the Licensee too will have the right to vacate the said premises by giving a notice in writing of one month to the Licensor as mentioned earlier.

  • Lock-in-period –

Sometimes it is a difficult task to search for the tenant for the premises and sometimes we need to take help of local agents/broker to get a tenant for the premises and have to pay 1-month rent as brokerage but what will happen after don above if the Tenant vacates the premises within 1 or 2 months. In such a situation, the owner of the premises will be in loss and have to suffer losses. Here lock-in-period clause comes for help. If lock-in period of 1 year is kept then the licensor could not push licensee to vacate the premises for next 1 year and even license could not leave the premises before 1 year.

If the licensor wants to vacate the premises then he need to compensate Licensee by paying the remaining lock-in period Rent and if Licensee wants to leave the Licensed premises then Licensee need to compensate Licensor by paying the remaining lock-in period Rent.

  • Lock in period:

Both the parties have agreed to set a lock-in period of — months during which neither the licensor shall ask the licensee to vacate the premises, nor the licensee shall vacate the premises on his own during the lock-in period. In spite of this mandatory clause, if the licensee leaves the premises for whatsoever reason, he shall pay the licensor license fee for the remaining lock-in period at the rate of agreed upon in the agreement. On the other hand, Licensor shall compensate the Licensee for loss and inconvenience caused to the Licensee if he has been asked to vacate the premises.”

THINGS TO BE CONSIDERED BEFORE SIGNING THE RENTAL AGREEMENT?

By Landlord/ Licensor/Owner

  • The agreement should clearly mention the terms in case the license failed to payment of rent, or there is damages to property, furniture & fixtures etc and the rights of the Landlord to deal with the same.
  • The premises shall only be used for the purpose it is rented for (residential/nonresidential). Example: A house rented for the residential purpose may not be used as a commercial office or shop etc
  • The provision or sub-tenancy and its implication must be discussed and provided in the Agreement.

By Tenant/ Licensee

  • The title of the Licesnor must be thoroughly verified to avoid any future conflicts. Sometimes it could be possible that the mother owns the property title but her son executes the agreement which makes the said agreement invalid.
  • A provision must be mentioned for the situation if the Landlord either expires or transfers/ sells the rented/licensed premises to another.

Both Parties

  • Must thoroughly read the Rental agreement form before signing the same.
  • Must obtain a copy of the Rental Agreement.
